United States CFTC crypto plan explained: what it means for buyers

The United States Commodity Futures Trading Commission (CFTC) has a plan for crypto rules. Here is what it covers, who it touches and how to comment by 14 December.

发生了什么

On 5 October 2026 the US Commodity Futures Trading Commission (CFTC) published an advance notice on crypto rules and asked for comment. Regulation CTX covers retail crypto purchases offered with leverage, margin or financing. Regulation CAM would create a new kind of registered exchange, a "crypto asset market". It is an early step, not a final rule.

In the CFTC's reading, a cash purchase can fall under the rules if the platform offered you financing, even if you said no. The way out is real delivery of the coins within 28 days. Its early view is that this may need the private keys. A line in the exchange's own books is not enough.

要核实和关注什么

Comments are due by 14 December 2026. Check where your coins sit: on an exchange or in your own wallet. Then see what the CFTC does next.

On 5 October 2026 the CFTC published an advance notice of proposed rulemaking, or ANPRM. It is the earliest step in the process. The agency says what it plans and asks the public for input before it writes any rule. The notice was posted on Regulations.gov on 13 October. The CFTC says it will use the comments to inform possible future action, such as a rulemaking.

Why now? CoinDesk reports that the Clarity Act, the market structure bill that was meant to settle who regulates crypto, stalled in the US Senate in September. The CFTC is working with a law it already has. Christopher Giancarlo, a former CFTC chairman, writes in The Hill that under the Commodity Exchange Act, retail commodity trades offered with leverage, margin or financing are treated like futures. Those trades have to happen on a CFTC-registered exchange, unless the commodity is actually delivered within 28 days.

Regulation CTX is about those trades. The notice says that the mere offer of leverage, margin or financing to a retail customer can bring the resulting fully paid transaction under CFTC jurisdiction, even if the customer declined the offer. That is why TokenPost reports that a plain cash bitcoin purchase can be caught. The exit is actual delivery. The CFTC's early view is that possession and control of a crypto asset may require the private keys to the wallet. TokenPost reads the notice to mean that an entry on an exchange's internal ledger alone would not qualify. All of this is preliminary and open for comment.

Regulation CAM is about the venues. It would create a subcategory of the designated contract market, the CFTC's licensed exchange type, built for these trades. CoinDesk describes it as an option for exchanges, not a duty. Trades would go through futures commission merchants, which are regulated brokers. Exchanges would not be allowed to list products that are easy to manipulate. Exchanges that keep customer coins in pooled omnibus accounts could face proof-of-reserves demands.

What the plan does not do. CoinDesk says it cannot replace state money-transmission rules for plain spot trading, although the CFTC can still police fraud and manipulation there. The Hill adds that spot-only exchanges stay under state law unless they opt in. Nothing changes for buyers today, because there is no final rule.

How to comment. Use Regulations.gov and name the document, "Regulation Crypto Asset Transactions and Regulation Crypto Asset Markets", with RIN 3038-AF80. The deadline is 14 December 2026, 11:59 PM Eastern time. Comments must be in English or come with an English translation. They are published without review, and personal details are not removed, so leave out anything you want to keep private.
